Terms of Service

Effective date: June 3, 2025

These Terms of Service (“Terms”) govern your access to and use of the ConstruTrack web application (the “Service”) operated by ConstruTrack (“we,” “our,” or “us”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

ConstruTrack is a construction daily reporting web application that allows construction organizations to create and manage daily reports, work logs, time cards, photo documentation, and incidents. Reports can be automatically compiled into branded PDF documents and distributed via email to designated recipients.

2. Accounts and Eligibility

You must be at least 18 years old to use the Service. By creating an account, you represent that you are 18 or older and have the legal authority to enter into these Terms on behalf of yourself or your organization.

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately if you suspect unauthorized access.

3. Free and Pro Plans

Free Plan

The Free plan is provided at no cost and includes limited functionality:

  • 1 project per organization
  • Up to 2 photos per daily report
  • Full daily report creation (work logs, time cards, notes, incidents)
  • PDF generation and email delivery

Pro Plan

The Pro plan is available by paid subscription and includes:

  • Unlimited projects
  • Up to 10 photos per daily report
  • All Free plan features
  • Priority support

Subscription fees are billed in advance on a monthly or annual basis via LemonSqueezy. You authorize us to charge your payment method on a recurring basis. Prices are subject to change with 30 days’ notice.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Upload content that is illegal, defamatory, harassing, or infringes third-party rights
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Use the Service to transmit malware, spam, or other harmful content
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Resell, sublicense, or otherwise commercialize the Service without our written consent

We reserve the right to suspend or terminate accounts that violate these rules without notice.

5. Intellectual Property

Your content: You retain full ownership of all data, reports, photos, and content you create or upload to the Service (“Your Content”). You grant us a limited, non-exclusive license to store, process, and transmit Your Content solely as necessary to provide the Service.

Our content: The Service, including its design, code, trademarks, and documentation, is owned by ConstruTrack and protected by applicable intellectual property laws. Nothing in these Terms grants you a right to use our trademarks or branding without prior written consent.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CONSTRUTRACK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100).

9. Termination

You may cancel your account at any time through your account settings. Cancellation takes effect at the end of your current billing period; you will retain access to Pro features until that date.

We may suspend or terminate your account immediately if you violate these Terms, if required by law, or if we discontinue the Service. Upon termination, your right to use the Service ceases. We will delete your data in accordance with our Privacy Policy.

10. Governing Law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.

11. Changes to These Terms

We may update these Terms at any time. We will notify you by updating the effective date above and, for material changes, by sending an email to your registered address. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
